1. Agreement to Terms

By accessing and using the BookOS mobile application, web application, and associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

BookOS ("Company," "We," "Our," or "Us") reserves the right to modify these Terms at any time. Your continued use of the Service following any modifications constitutes your acceptance of the updated Terms.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

2.2 Account Creation

To use the Service, you must create an account by providing:

  • Your full name
  • Valid email address
  • Phone number
  • Company information
  • Secure password

You are responsible for maintaining the confidentiality of your password and account information. You agree to provide accurate, complete, and truthful information during registration and to update this information as needed.

3. License and Use

3.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

3.2 Restrictions on Use

You agree not to:

Prohibited Activities:

  • Use the Service for any unlawful purpose
  • Infringe upon any intellectual property or privacy rights
  • Harass, threaten, defame, or abuse any person
  • Upload, post, or transmit viruses or malware
  • Attempt to gain unauthorized access
  • Reverse engineer or decompile the Service
  • Resell, lease, or transfer rights to the Service
  • Use automated tools without permission
  • Bypass or circumvent security measures

Data Misuse:

  • Collect or scrape data from other users without consent
  • Use guest information for purposes other than hospitality management
  • Sell or share customer data without proper agreements
  • Violate privacy or data protection laws

6. Payment Terms and In-App Purchases

6.1 Pricing

Pricing for BookOS services is displayed on our website and app. We reserve the right to change pricing with notice.

6.3 Payment Method

We accept payment through:

  • Credit and debit cards (processed by Stripe)
  • Subscription-based billing for premium features
  • Other payment methods as advertised

Important Payment Security Notice:

  • BookOS does NOT store, process, or have access to any credit card information
  • All payment processing is handled exclusively by Stripe
  • Stripe is PCI DSS Level 1 compliant
  • No credit card data is ever stored on BookOS servers
  • All payment data is encrypted and processed directly by Stripe

6.4 Refunds

  • Subscription refunds: Contact us at team@bookos.ai within 30 days of purchase
  • In-app purchase refunds: Handled by the app store (Apple or Google)
  • No refunds for continued access after cancellation

7. Account Termination and Deletion

7.1 Your Right to Delete Account

You have the right to delete your account and all associated data at any time. To delete your account:

In-App Deletion (Recommended):

  1. Open the BookOS app
  2. Go to Settings → Profile
  3. Scroll to "Delete Account"
  4. Confirm your password
  5. Click "Permanently Delete My Account"
  6. Confirm the deletion warning

7.2 What Gets Deleted

When you delete your account, the following data is permanently removed:

  • User profile information
  • Company information and settings
  • All properties and units
  • All reservations and booking history
  • All guest records
  • All transaction and financial records
  • All photos and uploaded files

Important: This action is permanent and cannot be undone.

8. Warranty Disclaimer

8.1 AS-IS SERVICE

The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis without any warranties of any kind, express or implied. We disclaim all warranties, including:

  • Warranty of merchantability
  • Warranty of fitness for a particular purpose
  • Warranty of title
  • Warranty of non-infringement

9. Limitation of Liability

9.1 Limitation of Direct Damages

IN NO EVENT SHALL BOOKOS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of revenue or income
  • Loss of business or profits
  • Loss of data or information
  • Business interruption

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall first be addressed through good faith negotiation between the parties. If negotiation does not resolve the dispute, either party may pursue legal action in the courts of Malaysia.
